Public Notice- Notice of Public Hearings – February 22, 2021

NOTICE OF PUBLIC HEARING

CITY OF WINTER HAVEN

Notice is hereby given that at its Regular City Commission Meeting, the Winter Haven City Commission will hold SECOND READING-PUBLIC HEARINGS on the proposed ordinances set forth below at 6:00 p.m. or soon thereafter Monday, February 22, 2021.

 The connection information for members of the public who wish to attend or participate in the Public Hearings via the Zoom virtual platform may be obtained by accessing the City’s website at http://mywinterhaven.com.   For persons wishing to attend the Public Hearings via the Zoom virtual platform, please insure that all registration and system requirements in order to connect to the Public Hearings via the Zoom virtual platform have been satisfied prior to the above mentioned date and time.

The public who wish to physically attend and participate in the Public Hearings may also come to the John Fuller Auditorium in City Hall located at 451 Third Street, N.W., Winter Haven, Florida, which will be open for members of the public on the above-mentioned date and time.  Social distancing and other Centers for Disease Control and Prevention (CDC) and Florida Department of Health (FDOH) guidelines pertaining to COVID-19 will be followed and observed.

The public is also invited to listen or watch the City Commission Meeting by visiting https://facebook.com/winterhaven.florida/ where the meeting will be live streamed.

All interested parties may appear at the meeting in the manners described above and be heard with respect to the proposed ordinances:

ORDINANCE NO. O-20-48

AN ORDINANCE AMENDING ORDINANCE 11-03, THE 2025 WINTER HAVEN COMPREHENSIVE PLAN, BY AMENDING FUTURE LAND USE ELEMENT OBJECTIVE 1.3 BY DELETING POLICY 1.3.8; PROVIDING FOR ADMINISTRATIVE CORRECTION OF SCRIVENER’S ERRORS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.

ORDINANCE NO.  O-21-03

 AN ORDINANCE AMENDING CHAPTER 21 OF THE CODE OF ORDINANCES OF THE CITY OF WINTER HAVEN, FLORIDA, BY REZONING A PARCEL FROM Highway commercial (C-3) ZONING DISTRICT TO SINGLE family residential- SMALL LOT (R-2) zoning district; PROVIDING FOR ADMINISTRATIVE CORRECTION OF SCRIVENER’S ERRORS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. (General Location: 2222 Ninth Street, NW.  The area covered by this request is 0.22± acres.)

 AN ORDINANCE AMENDING THE WINTER HAVEN CODE OF ORDINANCES, CHAPTER 21, ARTICLE II, DIVISION 2, FOR THE PURPOSE OF DELETING TABLE 21-32(B), TABLE OF COMMERCIAL, INDUSTRIAL, AND INSTITUTIONAL DEVELOPMENT STANDARDS AND MOVING THE REQUIREMENTS INTO SECTION 21-44, NEIGHBORHOOD COMMERCIAL (C-2), SECTION 21-45, HIGHWAY COMMERCIAL (C-3), SECTION 21-46, GENERAL (HEAVY) COMMERCIAL (C-4), SECTION 21-47, LIGHT INDUSTRIAL (I-1), SECTION 21-48, HEAVY INDUSTRIAL (I-2), SECTION 21-49, PUBLIC INSTITUTIONAL (PI), SECTION 21-50, PUBLIC RECREATION (PR), AND SECTION 21-51, CONSERVATION (CN); REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; THE ADMINISTRATIVE CORRECTION OF SCRIVENER’S ERRORS; CODIFICATION; AND PROVIDING AN EFFECTIVE DATE.

 ORDINANCE NO. O-21-05

 AN ORDINANCE AMENDING THE WINTER HAVEN CODE OF ORDINANCES, CHAPTER 21, ARTICLE III, DIVISION 6, SECTION 21-174, DUMPSTERS, FOR THE PURPOSE OF ADDRESSING PLACEMENT, ENCLOSURE DESIGN, MAINTENANCE, AND SCREENING CRITERIA; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; THE ADMINISTRATIVE CORRECTION OF SCRIVENER’S ERRORS; CODIFICATION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

 ORDINANCE NO. O-21-06- REVISED

AN ORDINANCE AMENDING CHAPTER 21, ARTICLE II, DIVISION 3, SECTION 21-69 OF THE CODE OF ORDINANCES OF THE CITY OF WINTER HAVEN, FLORIDA BY ADDING USES RELATED TO CHICKENS; PROVIDING FOR ADMINISTRATIVE CORRECTION OF SCRIVENER’S ERRORS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.

If any person decides to appeal any decision made by the City Commission with respect to any matters considered at such hearings, he/she will need a record of the proceeding and for such purpose he/she may need to ensure that a verbatim record of the proceeding is made, which record includes the testimony and evidence upon which the appeal is to be based (F.S. 286.0105). Please be advised individuals must make their own arrangements to produce this record.

The City Commission may continue the public hearings to other dates and times as it deems necessary.  Any interested party shall be advised that the date, time and place of any continuation of these or continued public hearings may be announced during the hearings and that no further notices regarding such matters may be published.
